The TUPE Regulations continue to produce difficult legal and commercial issues, particularly in relation to the outsourcing (and insourcing) of services. As the public sector comes under further cost pressure, these may become all the more acute. This session identified and explained the tricky legal issues which often arise, and the best practical way to deal with them.
Each session included an informative presentation from McGrigors as well as interactive discussions to illustrate the practical implications of the latest legal developments.
- Service Provision Change – examination of when a service provision change under TUPE applies and who transfers
- Preparing for a TUPE transfer – consideration of Information and Consultation obligations; disclosure of employment liability information and practical tips in preparing for an outsourcing
- Post transfer issues – examination of the liabilities which transfer; automatic unfair dismissal and the circumstances under which an employer can change terms and conditions
- TUPE update – a review of recent case law developments.
