The context

The Transfer of Undertakings (Protection of Employment) Regulations 2006 (“TUPE”), and how it protects employees when the business or undertaking for which they work transfers to a new employer, was the focus of the session.  During the event the followung questions were considered: 
    
When does TUPE apply?

  • Who transfers?
  • Cost/liability considerations
  • Information and consultation/ employee liability information
  • Reorganisation - harmonisation and redundancy
  • Special considerations in the public sector

The practical aspects of a TUPE transfer from: a transferee's perspective; a transferor's perspective and a service commissioner's perspective, were also considered whilst working through a detailed case study.
